Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LavaPi website at lavapi.com and any related services (collectively, the "Site"). By accessing the Site you agree to be bound by these Terms. If you do not agree, please do not use the Site.

LavaPi reserves the right to update these Terms at any time. Continued use of the Site after changes constitutes your acceptance.

LavaPi is a full-stack digital engineering company offering:

• AI & Machine Learning — LLM integration, RAG systems, AI agents, custom ML models, computer vision, natural language processing, and intelligent automation
• Cloud & DevOps — AWS, GCP, and Azure architecture, CI/CD pipelines, Kubernetes orchestration, cloud migration, security hardening, and cost optimisation
• Custom Software Development — web applications, SaaS platforms, backend APIs, internal tools, and legacy system modernisation
• Cybersecurity & Compliance — penetration testing, GDPR / SOC 2 / ISO 27001 compliance, vulnerability assessments, and identity & access management
• Mobile App Development — cross-platform iOS and Android applications using React Native and Flutter, including App Store and Play Store distribution and payments integration

The Site serves as a marketing and communications platform. Actual service engagements are governed by separate client agreements.

You agree not to use the Site or any of its features to:

• Violate any applicable law or regulation
• Transmit spam, malware, or any harmful content
• Attempt to gain unauthorised access to any part of the Site, our servers, or our databases
• Scrape, crawl, or harvest data from the Site using automated means without our written consent
• Impersonate LavaPi, our team members, or any other person or entity
• Interfere with or disrupt the Site's infrastructure or servers
• Use the AI chat widget to generate illegal, harmful, abusive, or deceptive content
• Circumvent any security, rate-limiting, or access-control features of the Site

We reserve the right to block access for any user or IP address that violates these rules.

Our Site includes an AI-powered chat widget powered by Anthropic's Claude model. By using the chat widget you acknowledge that:

• Responses are generated by an AI and may not always be accurate, complete, or up to date
• The chat widget is for general enquiry and information purposes only and does not constitute professional legal, financial, or technical advice
• Conversations may be reviewed by LavaPi team members for quality assurance and safety purposes
• You must not use the chat widget to share sensitive personal, financial, or confidential information
• The AI may occasionally produce incorrect or misleading outputs — always verify important information independently
• LavaPi is not liable for any decisions made based solely on AI chat responses

Submitting a contact form or booking request does not create a binding contract or guarantee engagement. It is an expression of interest that LavaPi will review and respond to at its discretion.

• We aim to respond to all enquiries within 24 hours on business days
• Booking slots are provisional until confirmed by a LavaPi team member
• Booking tokens are single-use and expire after 24 hours
• We reserve the right to decline any enquiry without providing a reason

All content on the Site — including text, graphics, logos, icons, images, code, and design — is the property of LavaPi or its content suppliers and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

Blog content: Articles published on our Insights blog are © LavaPi. Short quotations with attribution are permitted for non-commercial purposes. Full reproduction requires written permission.

Your content: Any content you submit to us (via contact form, chat, or otherwise) grants LavaPi a non-exclusive, royalty-free licence to use it for the purposes of responding to your enquiry and improving our services.

The Site may contain links to third-party websites. These links are provided for convenience only. LavaPi does not endorse, control, or take responsibility for the content, privacy practices, or availability of any third-party site.

Our Site integrates with third-party services including Supabase, Anthropic, AWS, Telegram, Unsplash, and ip-api.com. Use of those services is subject to their respective terms of service and privacy policies.

"As is" provision: The Site and all content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Accuracy: While we strive to keep all information accurate and up to date, we make no warranty that the Site content is complete, accurate, or current. Technology and pricing information in particular is subject to change.

Availability: We do not guarantee uninterrupted or error-free operation of the Site. We may suspend or discontinue the Site or any feature at any time without notice.

AI outputs: See Section 4 regarding the limitations of our AI chat widget.

To the fullest extent permitted by applicable law, LavaPi, its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site, including but not limited to:

• Loss of data or profits
• Business interruption
• Reliance on AI-generated content
• Unauthorised access to or alteration of your data

Our total liability for any claim arising from use of the Site shall not exceed €100.

Nothing in these Terms limits liability for fraud, gross negligence, or death or personal injury caused by our negligence.

Paid engagements with LavaPi for software development, AI, cloud, or other services are governed by a separate Master Services Agreement (MSA) or Statement of Work (SOW) signed by both parties. In the event of any conflict between these Terms and a signed client agreement, the client agreement prevails.

These Terms do not constitute a services agreement and do not create any obligation on LavaPi to provide services to any person.

Information you share with us through the contact form or chat regarding your business, projects, or technical requirements will be treated as confidential. We will not disclose it to third parties except as necessary to respond to your enquiry or as required by law.

For formal client engagements, mutual non-disclosure terms are included in our standard MSA.

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from use of the Site or these Terms shall first be attempted to be resolved through good-faith negotiation by contacting us at info@lavapi.com.

If a dispute cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the relevant competent courts.

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will update the "Last updated" date above. Significant changes will be notified via a Site notice. Continued use of the Site after any changes constitutes acceptance of the new Terms.
